1. Description of Service

Pancake is an AI-powered intelligence platform that generates structured analysis briefs for prediction markets, including those on Polymarket and Kalshi. Our services include browsing prediction market data, reading AI-generated intelligence briefs, and (for Pro subscribers) conversing with an AI research agent. We do not operate a prediction market, exchange, or brokerage.

Trades placed through Pancake are executed on Polymarket's CLOB (Central Limit Order Book). Pancake does not custody funds, match orders, or hold user assets. Trading prediction markets involves substantial risk of loss. See Polymarket's Terms of Use for full details.

2. Eligibility

You must be at least 18 years old to use Pancake. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. You are solely responsible for ensuring that your use of Pancake and any related prediction market activity complies with all laws and regulations applicable in your jurisdiction. Prediction markets may be restricted or prohibited in certain locations.

3. Accounts

You may browse markets and read cached briefs without creating an account. Certain features, including the AI chat agent, require you to create an account using email-based authentication (magic link). You are responsible for maintaining the security of your account. You may only maintain one account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free and Pro Tiers

Free Tier: Browse all markets with live prices. Access up to 3 intelligence briefs per day. No account required for browsing.

Pro Tier: Unlimited brief generation, AI chat agent for deeper research on any market, and access to all premium features as they become available.

5. Payment Terms

Pro subscriptions are available at $20 per month or $180 per year, billed through Stripe. Subscriptions auto-renew at the end of each billing period unless cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of your current billing period.

30-Day Money-Back Guarantee: If you are a first-time Pro subscriber and are not satisfied, you may request a full refund within 30 days of your initial purchase by contacting support@usepancake.com. This guarantee applies once per user and only to the first subscription payment. After the 30-day window, or for renewal payments, no refunds will be issued for unused time within a billing period.

We reserve the right to change pricing with reasonable notice. Founding member pricing, where offered, is locked for the lifetime of continuous subscription.

6. No Investment Advice

PANCAKE IS NOT A REGISTERED INVESTMENT ADVISOR, BROKER-DEALER, OR FINANCIAL PLANNER. NUSANTARA VENTURES, LLC IS NOT REGISTERED WITH THE SEC, FINRA, CFTC, OR ANY STATE SECURITIES REGULATOR. ALL CONTENT AND ANALYSIS PROVIDED THROUGH OUR SERVICES IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. NOTHING ON THIS WEBSITE CONSTITUTES A SOLICITATION, RECOMMENDATION, ENDORSEMENT, OR OFFER TO BUY, SELL, OR HOLD ANY PREDICTION MARKET POSITION, SECURITY, OR OTHER FINANCIAL PRODUCT.

We do not know and cannot account for your financial situation, risk tolerance, or investment objectives. You bear sole and complete responsibility for your own trading and investment decisions. We strongly encourage you to consult with qualified financial and legal professionals before participating in prediction markets.

7. AI-Generated Content Disclaimer

All intelligence briefs, analysis, and chat responses on Pancake are generated by artificial intelligence. This content is not reviewed, verified, or approved by human analysts. AI outputs may contain inaccuracies, errors, hallucinations, outdated information, or incomplete analysis. Confidence grades and assessments are algorithmic estimates and should not be interpreted as guarantees of accuracy. You should independently verify information before relying on it for any purpose.

Accuracy metrics, scorecard data, and historical resolution outcomes displayed on Pancake are provided solely for transparency. They should not be interpreted as evidence of future predictive ability, a track record of investment performance, or an inducement to trade.

8. Prediction Market Risk Acknowledgment

By using Pancake, you acknowledge and agree that:

- Prediction markets carry substantial financial risk, including the risk of total loss of capital. - Market outcomes are determined by third-party resolution mechanisms and oracles over which Pancake has no control. - Past accuracy of Pancake's assessments does not guarantee or indicate future accuracy. - Prediction market prices and data may be subject to manipulation, errors, or delays. - Prediction markets may be restricted or prohibited in your jurisdiction. - Pancake is not responsible for any trading losses you incur.

9. Acceptable Use

You agree not to:

- Scrape, crawl, or programmatically access Pancake without our written permission. Programmatic access is prohibited unless authorized under a separate API agreement or Polymarket Builder partnership arrangement. - Resell, redistribute, or commercially exploit our analysis or data. - Use automated tools, bots, or scripts to access our services in a manner that degrades performance for others. - Attempt to circumvent rate limits, paywalls, or access controls. - Use Pancake for any unlawful purpose. - Misrepresent your identity or affiliation.

10. User-Generated Content

When you use the AI chat agent, your messages ("Chat Content") are temporarily sent to third-party AI providers for processing. Chat Content is not persistently stored in our database. By using the chat feature, you grant Nusantara Ventures, LLC a non-exclusive, royalty-free, worldwide license to use anonymized and aggregated Chat Content to improve our services, including AI prompt optimization and product development, should we introduce chat persistence in the future. We will not publicly associate your Chat Content with your identity. You retain ownership of your Chat Content.

11. Intellectual Property

All intelligence briefs, analysis outputs, website design, branding, and proprietary methods are owned by Nusantara Ventures, LLC. You may share links to brief pages and quote brief content with attribution for non-commercial purposes. Market data displayed on Pancake is sourced from third-party platforms and remains the property of those platforms. Polymarket, Kalshi, and other third-party names, logos, and trademarks are the property of their respective owners. Pancake is not affiliated with, endorsed by, or sponsored by any prediction market platform.

12. Third-Party Data

Pancake displays market data from Polymarket, Kalshi, and other sources. This data is provided as-is. We do not guarantee the accuracy, completeness, reliability, or timeliness of third-party data. Discrepancies between our displayed data and platform data should be resolved by reference to the originating platform.

13. Service Availability

We do not guarantee uninterrupted or error-free access to Pancake. The service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We are not liable for any losses arising from service interruptions.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUSANTARA VENTURES, LLC, ITS MEMBERS, OWNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO: TRADING OR INVESTMENT LOSSES; RELIANCE ON AI-GENERATED ANALYSIS; INACCURATE, INCOMPLETE, OR DELAYED DATA; SERVICE INTERRUPTIONS OR DOWNTIME; UNAUTHORIZED ACCESS TO YOUR ACCOUNT.

ALL INFORMATION AND CONTENT PROVIDED THROUGH PANCAKE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless Nusantara Ventures, LLC, its members, owners, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable laws or regulations.

16. Termination

We may suspend or terminate your access to Pancake at any time, with or without cause and with or without notice. You may cancel your account and subscription at any time. Upon termination, your right to use Pro features ceases immediately. Provisions that by their nature should survive termination will survive, including limitation of liability, indemnification, and intellectual property.

17. Modifications

We may update these Terms at any time by posting the revised version on our website. Material changes will be communicated via email or prominent notice on the site at least 15 days before they take effect. Your continued use of Pancake after the effective date of changes constitutes acceptance of the updated Terms.

18. Dispute Resolution

Any dispute arising from these Terms or your use of Pancake shall first be attempted to be resolved through good-faith negotiation for a period of 30 days. If negotiation fails, disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Wilmington, Delaware. The arbitration shall be conducted in English. Judgment on the arbitral award may be entered in any court of competent jurisdiction.

YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST NUSANTARA VENTURES, LLC.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

21. Assignment

In the event of a merger, acquisition, reorganization, or sale of all or substantially all of our assets, these Terms and your account may be assigned to a successor entity. We will notify you of any such assignment via email or prominent notice on the site.
